29 CFR  1903.19(c)(1): The employer did not certify to OSHA, within 10 calendar days after the abatement date, that the cited violation had been abated:   a) On or about February 5, 2026, at the worksite, lot 21, Oakridge Lane, Macedon NY 14502: The employer failed to provide abatement certification for citation 1-1 (b) identified in the inspection of this workplace. An abatement certification demand letter was emailed to the employer on 5/7/2026.

29 CFR  1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   a) On or about February 5, 2026, at lot 21, Oakridge Lane, Macedon NY 14502: An employer and one of his employees were installing sheathing on estimated 7:12 pitch trusses without fall protection and exposed to an estimated 8-12 foot fall through the trusses.

29 CFR  1926.503(c)(3): Inadequacies in an affected employee's knowledge or use of fall protection systems or equipment indicate that the employee has not retained the requisite understanding or skill.  a) On or about February 5, 2026, at lot 21, Oakridge Lane, Macedon NY 14502: An employer and one of his employees were installing sheathing on estimated 7:12 pitch trusses without fall protection and exposed to an estimated 8-12 foot fall through the trusses. Employees were previously trained and failed to implement fall protection.  Abatement certification is required.
