29 CFR 1910.178(k)(1): The brakes of highway trucks shall be set and wheel chocks placed under the rear wheels to prevent the trucks from rolling while they are boarded with powered industrial trucks: Site- On or about January 20, 2026 an employee was not protected from a crushing and caught between hazard while operating a UniCarrier, model MUF1F2A28LV, forklift inside a trailer connected to a tractor unit where wheel chocks were not in use and the loading dock trailer locking device was out of service. The tractor trailer unit pulled away from the loading dock while a powered industrial truck was on the dock leveling plate; the dock leveling plate was engaged with the trailer unit and when the tractor trailer pulled away it caused the dock leveling plate to drop. When dock leveling plate dropped it caused the powered industrial truck to roll off of the loading dock.

29 CFR 1910.178(m)(5)(iii): Powered industrial truck(s), with the operator dismounted and within 25 feet of the truck still in his view, did not have the load engaging means fully lowered, controls neutralized, and the brakes set to prevent movement: Site- On or about January 20, 2026 an employee was not protected from a crushing hazard where the UniCarrier, model MUF1F2A28LV, forklift was parked on the door #2 loading dock without having the parking brake set. A third party tractor trailer unit was parked at loading dock #2 and pulled away from the loading dock while the powered industrial truck was on the dock leveling plate; the dock leveling plate was engaged with the trailer unit and when the tractor trailer pulled away it caused the dock leveling plate to drop. When dock leveling plate dropped it caused the powered industrial truck to roll off of the loading dock.

29 CFR 1910.178(a)(4): Modifications and additions which affect capacity and safe operation shall not be performed by the customer or user without manufacturers prior written approval. Capacity, operation, and maintenance instruction plates, tags, or decals shall be changed accordingly. a. Site- The UniCarrier forklift, model MUJ1F2A28LV and serial number UJ1F29V20006, has a rated lifting capacity of 4785 pounds; the forklift was in use with a Cascade clamp attachment, model number R500BCS630, with a maximum lifting capacity of 5000 pounds. The employer did not have manufacturers written approval to use the forklift with the clamp attachment and the forklift did not have it's identification plate changed to show the capacity of the forklift with the use of the clamp attachment. b. Site- The Nissan forklift, model MUJ1F2A28LV and serial number UJ1F29V0065, has a rated lifting capacity of 5050 pounds; the forklift was in use with a Darnell's Butt Buster roll cutter attachment, model number 74-30, with a maximum load capacity of 7400 pounds. The employer did not have manufacturers written approval to use the forklift with the roll cutter attachment and the forklift did not have it's identification plate changed to show the capacity of the forklift with the use of the roll cutter attachment.
