(a) At the jobsite - On or about February 12, 2026, the employer exposed employees to struck-by hazards, in that employees used a Milwaukee circular saw with the guard held open by a piece of wood that did not allow the guard to retract back in place before and after cutting the materials.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b).  (a)  On the Mayberry development jobsite at Lot 169 - On or about February 12, 2026, the employer exposed employees to a fall hazard, in that employees did not use fall protection while working from the first floor wall top plates to install ceiling joists with up to a 10' 6" fall to ground distance.
