29 CFR  1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure.   a.) On or about March 6, 2026, the employer engaging in a residential roofing construction job failed to protect employees from falls while employees installed new tar paper, and shingles on residential roof with a 4-12 pitch. In that the employer failed to install a fall protection system at the start of the roof replacement job exposing employees to a 7'5" fall hazard.

29 CFR  1926.1053(b)(1): When portable ladders are used for access to an upper landing surface, the ladder side rails shall extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access; or, when such an extension is not possible because of the ladder's length, then the ladder shall be secured at its top to a rigid support that will not deflect, and a grasping device, such as a grabrail, shall be provided to assist employees in mounting and dismounting the ladder. In no case shall the extension be such that ladder deflection under a load would, by itself, cause the ladder to slip off its support.   a.) On or about March 6, 2026, the employer did not ensure that the side rails of a portable extension ladder, being utilized by employees re-roofing a 4-12 pitch with a fall height of 7' 5" to the ground, extended at least 3 feet above the upper landing exposing employees to falls.

29 CFR  1926.1053(b)(4): Ladders shall be used only for the purpose for which they were designed.   a.) On or about March 6, 2026, the employer failed to ensure that a ladder was used only for the purpose for which it was designed, in that the lower section of an extension ladder was used as a stand alone ladder on the North (back) side of the residence, exposing employees to a fall hazard of approximately 7 feet 5 inches.  b.) On or about March 6, 2026, the employer failed to ensure that a ladder was used only for the purpose for which it was designed, in that the upper section of the same extension ladder was used as a stand alone ladder on the South (front) side of the residence, exposing employees to a fall hazard of approximately 7 feet 5 inches.

29 CFR  1926.1053(b)(15): Ladders shall be inspected by a competent person for visible defects on a periodic basis and after any occurrence that could affect their safe use.   a.) On or about March 6, 2026, the employer failed to ensure that a ladder used on site was inspected by a competent person for visible defects, in that the extension ladder had a missing rung lock on the left side of the base section and was also being used in separated sections,  exposing employees to fall hazards.
