OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish to each employee employment and a place of employment which was free from the recognized hazard of being caught in or between which was causing or likely to cause death or serious physical harm to employees in that employees were exposed to a struck-by hazard. On or about February 23, 2026, in the front yard area, employees were exposed to struck-by hazards while working beneath elevated vehicles that were supported by jack stands on surfaces that were not hard and level.

29 CFR 1910.244(a)(2)(i): In the absence of a firm foundation, the base of the jack was not blocked. On or about February 23, 2026, in the front yard area of the facility, where an employee was working beneath an elevated vehicle supported by a jack that lacked base blocking and was set on a non?firm and non?level surface.

29 CFR 1904.39(a)(2): The employer did not report within 24-hours a work-related incident resulting in in-patient hospitalization, amputation or the loss of an eye. On or about February 23, 2026, an employee was admitted into a hospital from the sustained injuries resulting from being struck-by a vehicle that fell over the employee when the jack stands tip over. The employer failed to notify OSHA as required.
