29 CFR  1926.1153(c)(1): For each employee engaged in a task identified on Table 1, the employer did not fully and properly implement the engineering controls, work practices, and respiratory protection specified for the task on Table 1, unless the employer assesses and limits the exposure of the employee to respirable crystalline silica in accordance with paragraph (d) of this section.  a) At the sidewalk located at 7218 Nipton Xing, Flowery Branch, GA 30524, on or about 3/10/2026, the employer exposed employees to respirable crystalline silica while dry cutting approximately 8?foot grooves into concrete using a Stihl TS420, 14?inch concrete saw. Engineering controls, work practices, and respiratory protection specified in Table 1 were not implemented, in that employees conducted dry cutting without wet methods, dust suppression, or appropriate respiratory protection, resulting in exposure to silica?containing dust.

Employees performing concrete cutting activities were not monitored or otherwise evaluated to determine their potential exposure levels, resulting in the inability to ensure that workers were not overexposed to respirable crystalline silica.
