29 CFR  1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.   (a)  Tank roof - On or about March 10, 2026, and times prior thereto, the employer exposed employees to a fall hazard, in that employees did not have fall protection while working on a roof with an 18'6" fall to ground distance.

29 CFR  1904.41(a)(1)(i): The employer's establishment had 20-249 employees during the previous calendar year and is classified in an industry listed in Appendix A to Subpart E of Part 1904, but the employer failed to electronically submit information from the establishment's OSHA Form 300A by March 2nd.   (a)  Facility - On or about March 2, 2026, the employer failed to electronically submit information from their OSHA Form 300A, Summary of Work-Related Injuries and Illnesses or equivalent form, for calendar year 2025 on or before March 2, 2026.  The establishment employed 46 employees during calendar year 2025 and was classified under NAICS code 237100.
