29 CFR  1910.132(d)(1): The employer did not assess the workplace to determine if hazards are present, or are likely to be present, which necessitate the use of personal protective equipment (PPE):  At the facility located at 11042 Strang Line Road, Lenexa, Kansas, the employer failed to assess the workplace to recognize, evaluate, and determine the types of personal protective equipment required to prevent employee exposure to chemical, fall, and struck-by hazards.

29 CFR  1910.178(p)(1):  Powered industrial truck(s) found to be in need of repair, defective, or in any way unsafe had not been  taken out of service until restored to safe operating condition(s):  Employee(s) operating and working around the YALE forklifts located at 11042 Strang Line Road, Lenexa, Kansas were exposed to struck-by hazards due to the forklifts having the following  defects:    (a) #22355 - Broken overhead light, missing gage cover for the battery, emergency stop button is difficult to pull out, deteriorated floor mats creating tripping hazard, no labeling of forklift control levers.  (b) #3 - Broken glass cover for battery gage, anti-static mat was damaged creating a tripping hazard, no labeling of forklift control levers, using the blade of a box cutter to turn the machine on or off.

29 CFR  1910.1200(h)(1): The employer did not provide employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment, and whenever a new physical or health hazard the employees had not previously been trained about was introduced into their work area:  Employees were exposed to health hazards.  Employees engaged in adding water to powered industrial truck batteries,  working with flammable liquids in the production department, among other tasks were exposed to health hazards in that the employer had not provided employees with effective information and training on the hazardous chemicals in their workplace.  Hazardous Chemicals used at the workplace include but are not limited to alcohol and sulfuric acid.
