29 CFR  1926.59:  The employer had not developed a written hazard communication program in accordance with 29 CFR 1910.1200 as incorporated by reference:  a) On the site located at 1430 Mableton Dr, Port Charlotte, FL: on or about 03/20/2026, the employer exposed employees to health hazards, in that, flammable liquids such as gasoline was being used on the site without having a hazard communication program developed for its use.

29 CFR  1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  a) On the site located at 1430 Mableton Dr, Port Charlotte, FL: on or about 03/20/2026, the employer exposed employees to fall hazards, in that, the ladder used to access the roof was not extended at least 3 feet above the landing surface.

29 CFR  1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   a) On the roof located at 1430 Mableton Dr, Port Charlotte, FL: On or about 03/20/2026, the employer exposed employees to fall hazards, in that, fall protection was not utilized by employees while performing framing work on a roof with a fall height of approximately 9 ft. 3 in.  The Reyes 8 Construction LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1687465, citation number 1, item number 1 and was affirmed as a final order on 09/13/2023, with respect to a workplace located at 2825 Star Coral Ln, North Fort Myers, FL.
