29 CFR 1910.95(d)(1): When information indicated that any employee's exposure equaled or exceed the 8-hour time-weighted average of 85 decibels, the employer did not develop and implement a monitoring program:  a) On or about March 31, 2026, at jobsite 4577 Southwest Cargo Way, Palm City, FL 34990, the employer did not develop and implement a monitoring program for employees exposed to noise equal to or exceeding the 8-hour time-weighted average of 85 dBA while cutting, grinding, and sanding. An employee was exposed to continuous noise levels at 91.95% of the allowable 8-hour time-weighted average action level (85 dBA). The equivalent dBA of 91.95% is 89.3 dBA. The sampling was performed for 463 minutes, and zero exposure was assumed for the 17-minute period not sampled.

29 CFR 1910.95(g)(1): The employer did not establish and maintain an audiometric testing program as provided by 29 CFR 1910.95(g) by making audiometric testing available to all employees whose exposures equal or exceed an 8-hour time-weighted average of 85 decibels:  a) On or about March 31, 2026, at jobsite 4577 Southwest Cargo Way, Palm City, FL 34990, the employer did not establish and maintain an audiometric testing program as provided by 29 CFR 1910.95(g) by making audiometric testing available to all employees whose exposures equal or exceed an 8-hour time-weighted average (TWA) of 85 decibels. An employee performing cutting, grinding, and sanding was exposed to continuous noise levels at 91.95% of the allowable 8-hour time-weighted average action level (85 dBA). The equivalent dBA of 91.95% is 89.3 dBA. The sampling was performed for 463 minutes, and zero exposure was assumed for the 17-minute period not sampled.
