29 CFR 1926.1052(c)(1)(ii): Stairways having four or more risers or rising more than 30 inches (76 cm), whichever is less, were not equipped with a stair rail system along each unprotected side or edge: a) Stairway: On or about April 1, the employer exposed employees to fall hazards of approximately 9 feet to the lower level, in that the stairway used for access was not equipped with a handrail system along each unprotected side or edge while employees were engaged in framing activities.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: a) Lot 285: On or about April 1, 2026, the employer exposed employees to fall hazards of approximately 22 feet to the lower ground level, in that a fall protection system was not provided to employees engaged in framing activities. Jose Luis Ramirez Hernandez was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1813799, citation number 1, item number 2, and was affirmed as a final order on 06-25-2025, with respect to a workplace located at The Braselton Village Subdivision, 390 King Village, Lot #26, Braselton, GA 30517, Back Roof.
