29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed. a) New residential construction located on Lot #85 Georgian Point Drive SE, Lawrenceville, GA 30040, Window on Second Level: On or about 04/07/2026, the employer exposed employees to fall hazards of approximately 12 feet, 5 inches to the lower ground level, in that a ladder with side rails extended 3-feet past the second level landing was not provided as the ladder used did not reach the second level in a location where employee accessed the second floor and ground level to perform framing installation activities.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: a) The employer fails to ensure effective measures to prevent fall hazards as demonstrated on or about April 7, 2026, from the front roof rafters of a residential structure located at Lot 85 Georgian Point Drive SE, Lawrenceville, GA 30045 where employees are installing plywood sheathing without a fall protection system in place, exposing them to falls of approximately 21 feet 5 inches. To abate this hazard, the employer must ensure employees are protected from falls using guardrail systems, safety net systems, or personal fall arrest systems. b) The employer fails to ensure effective measures to prevent fall hazards as demonstrated on or about April 7, 2026, from the roof rafters of a residential structure located at Lot 85 Georgian Point Drive SE, Lawrenceville, GA 30045, where employees are installing plywood sheathing without a fall protection system in place, exposing them to falls over 25 feet. To abate this hazard, the employer must ensure employees are protected from falls using guardrail systems, safety net systems, or personal fall arrest systems. Pursuant to 29 CFR 1903.19, the employer must submit documents describing the measure it is taking to ensure compliance, including an explanation of how these steps protect its employees from fall hazards. Jorge Garcia was previously cited for a violation of this occupation safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA Inspection Number 183000, citation number 1, item number 2 and was affirmed as a final order date on 09/08/2025, with respect to a workplace located at Lot 17 Creekside Landing, Suwanee, GA 30024. Jorge Garcia was previously cited for a violation of this occupation safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA Inspection Number 1837560, citation number 1, item number 2 and was affirmed as a final order date on 09/08/2025, with respect to a workplace located at Lot 7 Creek Indian Drive, Sugar Hill, GA 30518.
