29 CFR  1910.1000(a)(1): Substances with limits preceded by "C" - Ceiling Values. An employee's exposure to any substance in Table Z-1, the exposure limit of which is preceded by a "C", shall at no time exceed the exposure limit given for that substance. If instantaneous monitoring is not feasible, then the ceiling shall be assessed as a 15-minute time weighted average exposure which shall not be exceeded at any time during the working day. Employee(s) were exposed to an airborne concentration of carbon monoxide listed in Table Z-1 in excess of the ceiling concentration of 50 ppm:  (a) On or about April 17, 2026, an employee was conducting power washing, with gasoline powered equipment, of the floor to an underground garage, located at 1505 Washington Avenue in Grafton, Wisconsin, and was exposed to carbon monoxide levels in excess of 55 ppm.

29 CFR  1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:  (a) On or about April 17, 2026, an employee was engaged in power washing services was exposed to hazardous materials, such as but not limited to; diesel, gasoline, oils, and cleaning chemicals. The employer had not maintained a Hazard Communication/Globally Harmonized System (GHS) program, which would address labeling and other forms of warnings on hazardous material containers, Safety Data Sheets, and employee information and training on the hazards associated with the hazardous materials utilized on site, and is consistent with the GHS (29 CFR 191200(a)(1)).  The written program must also contain the following: 1. A list of all hazardous materials on site; 2. The methods the employer will use to inform employees of the hazards associated with non-routine tasks involving hazardous materials, such as spills, and; 3. The method the employer will use to inform other employers (contractors) of the chemicals their employees might be exposed to while performing duties at the site.
