Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish employment and a place of employment which were
free from recognized hazards that were causing or likely to cause death
or serious physical harm to employees in that employees were exposed to
the hazard of airborne overexposure to Captan fungicide at the Dust Mill
#1 on 12/2/87 in that the concentrations exceeded the time weighted
average of 5 mg/m3 as listed in the American Conference of Governmental
Industrial Hygienists Threshold Limit Values of 1986-1987 by more than a
factor of 3 (17.34 mg/m3). These airborne levels highly contribute to
excessive contamination in the immediate work area and to other areas
via foot traffic and create potential exposure to unprotected workers
who enter the over-exposure area.
Among other methods, some feasible and acceptable abatement methods to
correct this hazard are:
a) Implement ventilation engineering controls with improved capture
velocity when handling technical grade Captan fungicide.
b) Improve handling procedures to limit floor and airborne contamination
when handling full and empty bags of Captan fungicide.
