Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish employment and a place of employment which were
free from recognized hazards that were causing or likely to cause death
or serious physical harm to employees in that employees were exposed to:
a) Yard - Emergency use truck No. 337 had an inoperative rear turn
signal, one front headlight missing and the windshield wiper/
apparatus was missing, exposing employees to the hazard of being
struck by these vehicles while operating in the yard.
Among other methods, one feasible and acceptable abatement method to
correct this hazard is to replace all missing/defective turn signals,
headlights and windshield wipers.
b) Yard - Waste disposal truck No. 336 had two (2) excessively worn
tires on rear of truck; exposing employees to hazard of blow-outs
and loss of vehicle control.
Among other methods, one feasible and acceptable abatement method to
correct this hazard is to replace the defective windshield wiper motor.
c) Yard - Waste disposal truck No. 334; U. S. DOT No. 194816 had a
defective windshield wiper motor, exposing employees to the hazard of
being struck by or striking other vehicles or objects.
Among other methods, one feasible and acceptable abatement method to
correct this hazard is to replace the defective windshield wiper motor.
d) Yard - Waste disposal truck No. 332 had a missing tail/signal light
cover high mounted, rear of truck exposing employees to the hazard of
being struck by other vehicles.
Among other methods, one feasible and acceptable abatement method to
correct this hazard is to replace the missing tail/signal light cover.
