Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish employment and a place of employment which were
free from recognized hazards that were causing or likely to cause death
or serious physical harm to employees in that employees were exposed to
... crushing injury caused by defective automotive lifts.
Mechanics at Montgomery Ward Auto center are required to work under
and/or around the rotary automotive lifts known to have faulty seals
causing the lift to drop 6-8 inches without warning. The automotive
lifts were designed with safety latches built in to prevent the
lift from dropping completely without wa102513546WEVER, THE LATCHES
on at least one lift were rusted closed.
Feasible and effective abatement can be expected to include, but is
not limited to:
1) Cleaning of the safety latches;
2) Removal of water from underneath the auto bays;
3) Installation of new hydraulic seals in the affected lifts;
4) The use of four jack stands placed under the vehicle's frame
or suspension for support.
