Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not furnish employment and a place of employment which
were free from recognized hazards that were causing or likely to cause
death or serious physical harm to employees in that employees were
exposed to:
(a)  Operators of equipment were subject to the hazards of being
caught in crushing amputation, and death while operating equipment
that is defective due to lack of repair and/or overhaul as outlined
in the manufacturers manual for hours of use.
A feasible method of abatement includes but is not limited to:
1)  Establish and document the procedures which will be used in
performing maintenance in accordance with the manufacturers
recommendations.
2)  Develop, implement, and document an on-going safe machine
maintenance program for all operators, mechanics and management.
3)  Develop and implement a training program to instruct affected
employees.
4)  Train employees in the safe machine program.  Training shall
be repeated as frequently as is necessary to maintain management and
worker proficiency and compliance with the procedures.
