Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to being struck by hot asphalt:
On or about February 26, 1997 the Varec liquid level gage on tank #19 was
not maintained
in an operable condition in that it failed to indicate the correct liquid
level in the tank which
exposed employees to an overflow of hot asphalt at an estimated
temperatures.
Among Other Methods, one feasible and acceptable abatement method to
correct this hazard
is:  Properly maintain goggles and keep all employees clear of the area of
a potential
overflow during tank filling.
