Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish employemnt and a place of employment which were
free from recognized hazards that were causing or likely to cause death
or serious physical harm to employees in that employees were exposed to:
The hazards of fractures, bruises, sprains, and other injuries
associated with falling or being struck by a fork lift truck while
working in visibility reducing fog created by the leaking nitrogen
in the liquid nitrogen tunnel freezing area.
Among other methods, one feasible and acceptable abatement method to
correct this hazard is to establish a maintenance program where
leaking gaskets are replaced on a regular basis as soon as leaks
develop thereby controlling, to a great extent the fog being generated
by the leaking cabinet gasket.
