Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that the
employees were exposed to the hazards of being struck by or burned due to
the ignition of
pyrotechnic shells:
a.At the fireworks barge at the Rod and Reel Club and Lake Springfield, on
or about
July 3, 1998, employee(s) were exposed to the hazard of being struck by or
burned
due to the ignition of pyrotechnic shells.  Single break salute shells
greater than 3
inches were used.
One method of abatement to correct this apparent hazard is to limit the
size of single
break salute shells to 3 inches in diameter or in length as required by
NFPA 1123,
paragraph 2-1.7.1
b.At the fireworks barge at the Rod and Reel Club and Lake Springfield, on
or about
July 3, 1998, employee(s) were exposed to the hazard of being struck by or
burned
due to the ignition of pyrotechnic shells.  Mortars for shells exceeding 8
inches in
diameter that were to be electronically ignited, were not buried to a
depth of at least
2/3 to 3/4 of their length in troughs or drums.
One method of abatement to correct this apparent hazard is to limit the
size of shells
or place mortars in troughs or drums as required by NFPA 1123, paragraph
2-3.3
c.At the fireworks barge at the Rod and Reel Club and Lake Springfield, on
or about
July 3, 1998, employee(s) were exposed to the hazard of being struck by or
burned
due to the ignition of pyrotechnic shells.  Limited access to the area
where
pyrotechnic material were present was not established and maintained
during
the
preparation and handling of pyrotechnic shells.
One method of abatement to correct this apparent hazard is to enforce
limited access
to the area as required by NFPA 1123, paragraph 4-1.2.2
d.At the fireworks barge at the Rod and Reel Club and Lake Springfield, on
or about
July 3, 1998, employee(s) were exposed to the hazard of being struck by or
burned
due to the ignition of pyrotechnic shells.  Employees assisting in the
handling and
loading of pyrotechnic shells had knowledge of only the physical actions
to squib and
load shells.
One method of abatement to correct this apparent hazard is to use
assistance who are
fully trained in the proper performance of their tasks and educated with
regard to
safety hazards as required by NFPA 1123, paragraph 4-1.3.2
e.At the fireworks barge at the Rod and Reel Club and Lake Springfield, on
or about
July 3, 1998, employee(s) were exposed to the hazard of being struck by or
burned
due to the ignition of pyrotechnic shells.  No specific plan with
effective and directmeans of communication was used for spotters on the
shore and no one on the barge
was assigned or active as a spotter.
One method of abatement to correct this apparent hazard is to assign the
task of being
a spotter to a specific person or people and proved an effective means of
direct
communication as required by NFPA 1123, paragraph 4-1.4.3
f.At the fireworks barge at the Rod and Reel Club and Lake Springfield, on
or about
July 3, 1998, employee(s) were exposed to the hazard of being struck by or
burned
due to the ignition of pyrotechnic shells.  Smoking occurred within 50
feet of
fireworks or other pyrotechnic materials.
One method of abatement to correct this apparent hazard is to enforce no
smoking
rules as required by NFPA 1123, paragraph 4-1.6
g.At the fireworks barge at the Rod and Reel Club and Lake Springfield, on
or about
July 3, 1998, employee(s) were exposed to the hazard of being struck by or
burned
due to the ignition of pyrotechnic shells.  Unprotected employee(s) were
within 75
feet of mortars.
One method of abatement to correct this apparent hazard is to remove
workers from
within 75 feet of mortars or position workers behind a protective barrier
as required
by NFPA 1123, paragraph 5-1.3
h.At the fireworks barge at the Rod and Reel Club and Lake Springfield, on
or about
July 3, 1998, employee(s) were exposed to the hazard of being struck by or
burned
due to the ignition of pyrotechnic shells.  Fireworks had been attached to
electrical
firing unit and in the process of testing.  All people were not removed
from the
immediate area of the fireworks.
One method of abatement to correct this apparent hazard is to remove
people from the
immediate area of any fireworks attached to an electrical firing unit when
any circuit
testing is performed as required by NFPA 1123, paragraph 5-3.5
