Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The %% employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: Throughout the maintenance shop and into the storage warehouse next door schedule 40 PVC pipe was used for supplying 80-120 PSI compressed air, exposing employees to the potential hazard of the pipe failing and/or shattering. Among other methods, one feasible and acceptable method to abate this hazard would be to install metal piping, approved for that use, or encase the PVC pipe in shatter-proof material as advised by the PVC pipe manufacturer.
