Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a)The hazards of drowning in sewage, water or fuel in the USNS Flint's CHT tanks, fuel tanks and ballast tanks. The employer failed to ensure that, if more than one employee was working on a component or system, that each employee installed their own lock or tag. One feasible and acceptable means to correct this hazard is to follow the COMSCINST 5100.17C, 13 March 1998, Lockout/Tagout Procedures. Section 1702, Procedures, h., 4., states: "If more than one person is working on a component or system, they shall each install their own lock and tag. The lock shall be applied to a multiple lockout hasp. Upon completion of the task, that person shall remove only their own lock and tag."
