Note: The employer may discontinue an employee's medical evaluations when the employee is no longer required to use a respirator. (Construction Reference 1926.103(a)): On or about January 20, 2026 in the Dusit Place Hotel first floor office, an employee wearing a 3M Particulate Respirator 9001 while using a chipping hammer to remove floor tiles, was not medically cleared prior to use.

29 CFR 1926.1153(c)(1): For each employee engaged in a task identified on Table 1, the employer did not fully and properly implement the engineering controls, work practices, and respiratory protection specified for the task on Table 1, unless the employer assesses and limits the exposure of the employee to respirable crystalline silica in accordance with paragraph (d) of this section. On or about January 20, 2026 in the Dusit Place Hotel First floor office, an employee was using a chipping hammer to remove floor tiles without any control measures other than respiratory protection implemented from Table 1-Specified Exposure Control Methods When Working with Materials Containing Crystalline Silica.
