Section 5(a)(1) of the Occupational Safety and Health Act of 1970: the employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being struck by a suspended load: a) On November 19, 1991 at approximately 4:20 at the corner of 1301 North Howard Avenue and Arch Street, employees standing on the east side of the building where an excavation of 25 feet in width, 40 feet in length and approximately 15 feet deep were exposed to being struck by an uncontrolled suspended gasoline storage tank: Other methods, one feasible and acceptable abatement method to correct this hazard is to utilize tag lines to control loads to be lifted/moved.
