Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a) Being struck by one of the two Fiat-Allis, Model 605, Wheel Loaders. (b) Being crushed, in the event the building would collapes if one of the two Fiat-Allis, Model 605, Wheel Loaders, would strike the vertical structural members, causing the roof to fail. The two Fiat-Allis, Model 605, Wheel Loaders,were being operated with no brakes, while handling bulk fertilizer in the Bulk Fertilzer Building. Amoung other methods, one feasible and acceptable abatement method to correct this hazard is to repair the brakes on the two Fiat-Allis, Model 605, Wheel Loaders. Maintenance of the brakes on the two Fiat- Allis, Model 605, Wheel Loaders, should be performed in accordance with the manufacture's instruction. Employees should be trained safe operating procedures of the two Fiat-Allis, Model 605, Wheel Loaders. Employees should be instructed in the hazards of striking the upright support members of the structure with the Fiat-Allis, Model 605, Wheel Loaders, and it's effect on the structure's integrity.
