The employer is not limited to the abatement methods suggested by OSHA; the methods explained are general and may not be effective in all cases; and the employer is responsible for selecting and carrying out an effective abatement method. Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: At Rig #1 employee was tightening a sensor with no fall protection exposing the employee to a fall of approximately 12 feet while holding with one hand the outside rail. One feasible and acceptable abatement method among others to correct the hazard is to assure employee(s) working outside the stair rails shall wear a safety belt with appropriate lanyard and safety attachment and adjusted to prevent a fall of more than five (5) feet such as specified by API RP54 first January 1981, page 13 section 5.4 Safety Belts and Lanyards. This condition occurred on or about August 26, 1993 at approximately 10:30 a.m.
