Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish employment and a place of employment which were
free from recognized hazards that were causing or likely to cause death
or serious physical harm to employees, in that, working conditions and
recognized hazards of possibly becoming overcome by toxic gas, oxygen
deficient atmosphere, and carbon monoxide, while performing work duties
from points located within manholes, shafts, and tunnels:
Jobsite: Manhole #9293, Summer Street entrance to tunnel: Drew
Electrical Co., Inc., employees entered a manhole and tunnel without
following a confined space entry program procedure. Employees were
exposed to the hazard of being asphyxiated due to the possiblelack
of oxygen at their work locations, or being overcome by carbon
monoxide or other contaminants.
Among other methods, one feasible and acceptable abatement method to
correct this hazard is to establish and enforce an adequate confined
space entry procedure such as that stipulated by NIOSH Criteria Document
Publication No. 80-106, December, 1979, which would include providing
telephone or other signal communication(s) between stand by personnel
and the employees in the confined space, training and providing
instructions of the hazards and routine safety procedures/precautions
of carbon monoxide, oxygen deficient atmospheres, and to other gasses
associated with their working environment; and other aspectsof NIOSH
Publication #80-106.
