Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to:
a) ...of being crushed by misrouted locomotives and freight cars during
switching operations
over and near the J track crossover in the eastern yard of the BayTank
facility, Freeport, TX.
Among other methods, one feasible and acceptable abatement method to
correct this hazard is
to ensure that all switch targets are properly oriented in relationship
with the throw of the switch
points, as required by Paragraph 8.2 of the company's General Code of
Operating Rules,
January 1, 1995 edition.
