Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being struck by a flying piece or section of chain: (a) Facility, 301 S. Chestnut Street, Butler, PA 16001; (1) Loads of unknown amounts were imposed on chains for which the employer did not know the working loads, during automotive body straightening operations. (2) Chains with visible damage, such as elongation, twisting, gouges, cracks and so, have loads imposed during automotive body straightening operations without any testing done to determine whether they were capable of withstanding the loads being imposed on them. Feasible and useful means of abatement are to: 1. Determine the maximum loads imposed on the chains with a measuring device. 2. Obtain chains for which the working loads are known and do not exceed those loads. 3. Remove all damaged chains from service and do not put them back into service until: (a) They are repaired in accordance with manufacturer's instruction, or (b) They are tested in accordance with manufacturer's instructions.
