Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to multiple injuries from a fall: (a) Smitty's Clean Scene Construction Site - Employee(s) exposed to fall hazard of approximately fourteen (14) feet while installing aluminum cap on roof edge and were not provided with safety belt and lanyard, or catch platform, on or about July 15, 1991. Among other methods, one feasible and acceptable abatement method to correct this hazard is to provide and wear safety belt and lanyard. OR IN THE ALTERNATIVE 29 CFR 1926.28(a): Appropriate personal protective equipment was not worn by employees in all operations where there was exposure to hazardous conditions: (a) Smitty's Clean Scene Construction Site - Employee(s) exposed to fall hazard of approximately fourteen (14) feet while installing aluminum cap on roof edge and were not provided with safety belt and lanyard, or catch platform, on or about July 15, 1991.
