Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: The hazard of being struck by refuse containers in the process of being emptied into the rear of refuse collection trucks. Various work locations throughout Westchester County, Including, but not limited to 100 Clearbrook Drive, Elmsford, NY 10523. On or about 12/30/95 a) Employee assisting in the dumping of refuse containers are exposed to the hazard of being struck and killed by the container while they are being emptied into the rear of the refuse collection truck. Hudson Waste Haulage, Inc., Trucks, #43, #46, #52, #58, are not equipped with container retention systems, and hook latches. The Employees utilizing these trucks were not provided with training in the proper dumping procedures and were allowed to run the compaction blade prior to lowering the refuse containers to the ground. "AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD TO CORRECT THIS HAZARD IS..." 1. Train employees and document such training as per the Leach owners manual, pg#2-3. 2. Provide employees with training as set forth in ANSI Z245.1 - 1992, section 6.1a. 3. Follow the safety precautions set forth in the owners manual, provided by Leach Company, for the "Rear Loader Container Handling Systems", pg's 1-1, 1-2, 1-3, 1-4, 2-1, 2-2, 2-3, 3-1, 3-2, 3-3, 3-4, 4-1, 4-2, 6-5, and 6-6. 4. Follow the American National Standards Institute (ANSI) requirements for safe operating procedures, contained in ANSI Z245.1 - 1992 Mobile Refuse Collection and Compaction Equipment - Safety Requirements for Refuse Collection, Processing, and Disposal Equipment, sections 6.1, 6.2, 7.2.2.6. 5. Utilize the Container Retention Systems that were provided on the trucks by the manufacturer, and removed by the employer, as set forth in the ANSI Z245.1 - 1992, section 7.2.2.6.1 a, and in the Leach Manual on pgs 1-1, 1-2, 1-4, 2-1, 2-2, 2-3, 3-1, 3-2, 3-3, 3-4, 4-1, 4-2, 6-5, 6-6. 6. Utilize the Hook Latches that were provided on the hooks by the manufacturer, and not maintained by the employer, as set forth in the ANSI Z245.1 - 1992, section 7.2.2.6.1 b, and in the Leach Manual on pgs 1-2, 2-1, 2-2, 2-3, 3-1, 3-3, 4-1, 4-2. 7. Not allow employees to cycle the compaction mechanism "blade" while the containers are in a raised position as per the Leach Operators Manual pg 3-3.8. Perform Daily and Monthly inspections as set forth in the ANSI Z245.1 - 1992 standard, section 6.1k and in the Leach Manual on pg 4-1, and 4-2. 9. Perform maintenance as specified in the Leach owners manual pg 4-1. 10. Affix safety related decals as per the Leach owners manual as shown on pg 2-2.
