Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: (a) An employee was exposed to a potential fall hazard while operating the manually operated manlift due to the lack of a car enclosure. Among other methods, one feasible and acceptable method to correct this hazard would be to install an enclosure, with an entrance gate, on the car. (b) An employee was exposed to a potential crushing hazard while working near the manually operated manlift due to the lack of guardrails around the base of the manlift. Among other methods, one feasible and acceptable method to correct this hazard would be to install guardrails, with an entrance gate, around the base of the manlift.
