Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to falling off an elevated forklift platform:
a)Joeten Motors Beach Road Oleai Saipan: The pallet provided by the
employer to raise
personnel with the use of a forklift was not appropriate for such tasks.
Hazards included
a lack of fall protection, platform was not adequately secured, the
working platform did
not contain a slip resistant floor surface, and its loading
capabilities/limits were unknown.
An employee was exposed to a fall of 12 feet to the ground when installing
a new flag
sign while being elevated on the pallet.
