Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not furnish employment
and a place of employment which were free from recognized hazards that
were causing or likely to cause
death or serious physical harm to employees in that employees were exposed
to a crushing hazard due to
potential roll-over when operating ride-on tractor(s) and mower(s) on
sloping embankments:
(a)J.P. Mascaro & Sons, 600 West Neversink Road, Reading, PA - An employee
was operating a
Kubota B7500 Tractor, serial number 59970, with an attached brush hogg on
a sloping
embankment without the use of a seat belt and rollover protective
structures (ROPS). The
ROPS were not fully utilized exposing employee(s) to a crushing hazard and
serious injuries in
the event of a rollover, on or about August 12, 2009.
Among other methods, feasible and acceptable methods to correct this
hazard includes:
1.Follow the operator's safety manual requirement that all operators wear
a
seat belt while
operating the equipment.
2.Use fully extended ROPS as required by 29 CFR 1926.1002 and 29 CFR
1928.51.
