Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to:  THE HAZARD OF BEING CRUSHED BY MOBILE
EQUIPMENT AND/OR FALLING OFF THE EQUIPMENT:
a)Maines Job Site, Broome Corp. Park, on or about 4/10/97:  An employee
was operating a Case backhoe with two employees riding (one on each
side) with no additional seating/securing.  Employees exposed to fall and
struck by hazards.
ABATEMENT NOTES;
AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE
ABATEMENT METHOD TO CORRECT THIS HAZARD IS TO HAVE
THE EMPLOYEES WALK TO THE WORK LOCATION.
