Section 5(a)(1) of the Occupational Safety and Health Act of 1970:
The employer did not furnish employment and a place of employment which
were free
from recognized hazards that were causing or likely to cause death or
serious physical
harm to employees in that employees were exposed to:
(a)A crushing hazard, on April 15, 1996, in which a powered industrial
truck
operating in the Yard Area of Payless Cashways at 6110 Irvington Road,
Omaha, Nebraska, overturned.  As a result, the operator, who was not
wearing the seat belt provided on the truck, was killed.
Among other methods, one feasible and acceptable method to control the
hazard is to develop and implement written procedures requiring operators
of powered industrial trucks to wear the seat belts provided when
operating trucks.  Retrofitting, necessary to install seat belts on powered
industrial trucks without them, will be accomplished in accordance with
safe design.
