Section 5(a)1 of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing hazards from steel rack units and/or its contents: The following equipment used by employees at the workplace were not maintained in accordance to manufacture or national consensus standards exposing employees to crushing hazards. Warehouse - the racks in areas 10, 11, 13, 15, and 17 which support food products and other materials and in all other areas where damaged racks are located, the employer did not ensure that steel storage racks in use at the facility were inspected and maintained in accordance with the manufacturer's requirements and with the American National Standards Institute guidelines for the use of industrial and commercial steel storage racks. Among other methods, one feasible and acceptable method to correct this hazard is: To follow the recommendations of the Rack Manufactures Institute Specifications for the Design, Testing, and Utilization of Industrial Steel Storage Racks 1995 Edition, Section 1.4.1 to develop and implement a structural integrity program to periodically inspect and repair storage racks. 29 CFR 1903.19(c)(1) requires certification that the abatement of the above violation is completed.
