Section 5(a)(1) of the Occupational Safety and Health Act of 1970:
a)  Weaversville Treatment Unit Construction Site - In order to check
grade on the
excavation the rodman was hoisted over the excavation in the bucket of the
HITACHI
excavator.  This employee was thus exposed to a fall hazard from the
bucket.
Among others one feasible and acceptable method to abate this hazard is to
refrain from
hoisting personnel in the bucket of the excavator.
