Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that: Employee(s) were exposed to the hazard of falling while using an 8 foot fiberglass ladder on top of a 9 ft. 6 in. high truck. Among other methods, a feasible and acceptable abatement in accordance with provisions stipulated in ANSI/A14.5-1992 for Ladders--Portable Reinforced Plastic, Paragraph 9.3.1. - 9.3.2.1 as applicable. Essential Elements include, but are not limited to, the following: 1. Step ladders shall be used only in a fully-open position. 2. Users shall climb or step no higher than the step or rung indicating the highest standing level on a sepladder. 3. The step ladder base shall be placed with a secure footing on a firm, level support surface. 4. Users shall ensure that the step ladder is fully opened, with spreaders locked, and all feet contacting a firm level support surface. No additional abatement information is required for this item.

Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that an employee was exposed to a potentially hazardous energy source that was not locked or tagged out by the employee: Employee using a fiberglass step ladder on top of a truck did not have control of the accidental start-up of that truck. Feasible abatement methods include, but are not limited to: 1) Not placing the ladder on the top of the truck. 2) Develop a written lockout/tagout program that complies with the American National Standards Institute (ANSI) standard for Personnel Protection- Lockout/Tagout of Energy Sources Minimum Safety Requirements, ANSI Z244.1. 3) Train all employees on the proper methods of lockout/tagout. No additional abatement information is required for this item.
