Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause, death or serious physical harm to employees in that employees were exposed to the hazard of being crushed between the lift and floor due to the failure of the hydraulic system. The lifts had defective locking devices which would not engage when the lifts were fully extended. Additionally, employees often work under the lifts when they are not fully extended and no locking device is available. The lifts can not be held in position as stipulated by ANSI B153, 1-1990, Section 4.4 American National Standard for the Construction, Care and Use of Automotive Lifts. Frame jacks had leaks in the lift cylinder lines which prevented the jacks from lifting vans and heavy vehicles. Employees had to manually assist the jacks to lift heavy vehicles. The lifts were not maintained as stipulated by ANSI B153.11990, Section 7.1.2 American National Standard for the Construction, Care and use of Automatic Lifts. Among others, one feasible method to correct the hazard would be to repair the defective lock mechanisms, provide lift stands for use when the lifts are not fully extended, and repair frame jacks. If the repaired frame jacks will not lift the heavier vehicles, they will have to be replaced with ones that can.
