Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a. On or about March 26, 1997, on the manufacturing floor at the glass loading area for the production line, an employee stood on the raised forks of a forklift truck (positioned over a dumpster) breaking glass, thereby exposing him to the hazards of broken bones,lacerations, and cuts in the event of falling from the forks of the industrial truck. Feasible and useful abatement methods for eliminating or alleviating this hazard, among others are: 1. A platform should be secured to the lifting carriage or forks. 2. Restraining means such as rails, chains, etc., should be in place, or a body belt with lanyard or deceleration device should be worn by the person(s) on the platform. The body belt should be designed to snugly and comfortably fit all personnel using the platform. 3.An operator should be in the control position of the truck or available to operate controls.
