Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: At Ervin Cable Construction employees were exposed to mechanical and operational hazards associated with operating the 1999 F450 #417 - Altec Aerial Device and the 1984 F350 #312 - Versalift Aerial Device. a. Employees used Trucks #312 with a Versalift Aerial Device and #417 with an Altec Aerial Device and the employer did not ensure that the devices were frequently inspected in order to identify defects in the equipment, ANSI A92.2, Section 8.2.2; b. Truck #312 was equipped with a Versalift Aerial Device and the employer did not ensure that the unit was equipped with an owners manual, ANSI A92.2, Section 8.11; and, c. Truck #417 was equipped with a Altec Aerial Device and the employer did not ensure that the safety interlocks were not altered, ANSI A92.2, Section 8.13.4. Among other methods, feasible and effective means of abatement to correct these hazards is to ensure that the operating manual is stored on the mobil units, ensure that the frequent inspection are performed on the units, and ensure that modifications or alterations are not made on safety devices of the units.
