Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The

furnish employmnent and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to the the hazard of being infected with Mycobacterium
tuberculosis through the
repeated handling and manipulation of biological samples including, but
not limited to sputum
samples, during Mycobacterium tuberculosis testing in that:
(a)On 9/16/94 at MDS-Laboratories, 191 Delafield Street,
Poughkeepsie:  Workers, such as medical laboratory technicians
and technologists, were exposed to the hazard of being infected by
tuberculosis during M.tubercluosis testing, in that medical
screening, training and education, and the use of appropriate
biosafety procedures were not provided.
Feasible and useful abatement methods for reducing this hazard as
recommended by the Centers
for Disease Control, among others are:
1.  Provide medical surveillance (at no cost to employees) including
preplacement
evaluation, administration and interpretation of TB Mantoux skin tests,
and periodic
evaluations.  The frequency of the tests must be in accordance with
current CDC
guidelines.
2.  Conduct appropriate training to ensure employee knowledge of such
issues as the
hazard of TB transmission, its signs and symptoms, medical surveillance
and therapy,
and site-specific protocols including the purpose and proper use of
controls.  Assure that
personnel receive annual updates, or additional training as necessary for
procedural or
policy changes.
3.  Follow the biosafety practices as described in CDC/NIH publication
93-8395,
Biosafety in Microbiological and Biomedical Laboratories, including, but
not limited to:
(a)Restrict access to areas of laboratory where potential TB
containing specimens are located
(b)Decontaminate liquid or solid wastes before disposal
(c)Reduce/eliminate transport of slides from one lab to another, and
(d)Leave biosafety cabinet on at all times.
