Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to the hazard of getting their hands caught in between the
handle and the load
backrest bars of a pallet jack.
(a) Loading Dock Area:  The blue giant pallet jack was set up in such a
way that the load
backrest bars could be lowered onto the operator's hands while holding
onto the handle.  Among
other methods, feasible and acceptable abatement methods to correct this
hazard are to eliminate
the horizontal bars from the load backrest or to redesign the handle so it
cannot be possible to
get the operator's hands in the load backrest area while holding onto the
handle.
