Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not furnish employment
and a place of employment which were free from recognized hazards that
were causing or likely to cause
death or serious physical harm to employees, in that employees were
exposed to the hazard of crushing
injuries and death while working around and operating the Ford 4500, Model
040220, bucket tractor and the
Trojan 1500 front end loader earth moving equipment:
On or about July 17, 2006, an employee working in between the Ford 4500
tractor facing an easterly direction
and the Trojan 1500 front end loader facing a westerly direction was
caught-in between the two earth moving
pieces of equipment when the Trojan front end loader rolled forward in the
direction of the Ford Tractor.
Consequently, an employee sustained a serious upper left leg contusion
with negative fractures when the
Trojan 1500 front end loader rolled forward in a westerly direction
towards the direction of the Ford 4500
tractor temporarily pinning the employee between both pieces of equipment.
Among other methods, feasible and acceptable abatement methods to correct
this hazard would be to:
1) Implement a maintenance and servicing schedule for the Trojan 1500
front end loader and the Ford 4500
tractor in accordance with the manufacturer's recommended guideline, and,
2) Develop and implement a training program for operators of the Trojan
1500 front end loader and the Ford
4500 tractor.
