Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: A) BEING STRUCK BY FALLING LIFT AND SUSPENDED LOAD. THE TWO SINGLE POST AUTOMOBILE LIFTS LOCATED IN THE REPAIR BAYS ON THE SOUTH WALL OF THE GARAGE DID NOT HAVE WORKABLE AUTOMATIC MECHANICAL DEVICES, CAPABLE OF HOLDING THE LIFT AND ITS SUSPENDED LOAD IN THE FULLY EXTENDED POSITION AS REQUIRED IN ANSI B153.1-1974. THE LIFT LOCATED ON THE LEFT WAS MISSING THE LOCKING PIN ASSEMBLY AND THE LIFT ON THE RIGHT WAS MISSING THE ENTIRE MECHANICAL DEVICE NECESSARY FOR PROPER FUNCTIONING. IN THE EVENT OF HYDRAULIC FAILURE, THE SAFETY DEVICES WOULD NOT BE CAPABLE OF SUPPORTING THE SUSPENDED LOAD. A FEASIBLE AND USEFUL METHODTO CORRECT THIS HAZARD IS TO REPAIR THE EXISTING SAFETY SUPPORT ON THE LEFT SIDE LIFT AND INSTALL A SAFETY SUPPORT ON THE RIGHT SIDE LIFT AND CONTINUE TO MAINTAIN THEM SO THAT THEY ARE ALWAYS IN WORKING ORDER.
