Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the condition(s) listed below: On August 3, 2006, and the time previous to that date, a workover rig with a telescoping mast was being used to remove sucker rods from a well on the Kendrick B lease west of Kermit, Texas. This rig was not in maintained in safe condition, in that the following conditions were found: a) The mast was twisted in such a manner that the crown block was out of alignment with the drawworks by almost 45 degrees. This produced undue stress and wear on the sheaves in the crown block and the wire rope running through them. It also created an unsafe condition in that a sideways force was placed on the wire ropes as they passed through the sheaves of the crown block, which could lead to failure of the crown block which would release of the wire ropes holding the traveling block and its load, dropping them onto the crew below. b) The guy wires that were used to stabilize the mast were attached with only a single wire rope clip, instead of the minimum of 3 clips. Two of the guy wires had clips with the saddle mounted on the dead end, as well. The guy wires were thus not installed properly, and the stability of the mast was not ensured. c) The mast and supporting structures were rusted, with the paint in poor condition and incapable of preventing further corrosion. They were thus in need of a thorough cleaning and inspection to determine whether these structures retained sufficient structural integrity to be used. Employees working on this rig were thus not assured of a safety and healthful workplace, in that they were exposed to the hazard of being crushed by falling machinery or equipment.
