Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious
physical harm to employees in that employees were exposed to:
a.)  On or about 2-3-99, at approximately 7:30 P.M., an employee was
loading a semi-trailer
in the warehouse, building 54-1 at dock #18.  The employee was exposed to
the
hazard of being
pinned between a forklift and the ground in the event of a tipover, due to
the fact that the forklift
operator was not required to wear the seat belt provided on the Hyster
forklift serial number
F108V01908R.
b.)  On or about 2-2-99, an employee was loading scrap refrigerator
cabinets into a semi-trailer
at the scrap loadout area, department 2400 of building 62.  The employee
was exposed to the
hazard of being pinned between a forklift and the ground in the event of a
tipover, due to the
fact that the forklift operator was not required to wear the seat belt
provided on the Hyster
forklift serial number C001812493N.
"Among other methods, one feasible and acceptable abatement method to
correct this hazard is
to require the use of seat belts provided on the forklifts in accordance
with ASME/ANSI B56.1-
1995, Safety Standards for Low Lift and High Lift Trucks Section 5.3.19."
