Section 6(a) of the Puerto Rico Occupational Safety and Health Act:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or physical harm to employees in
that employees were
exposed to:
Seccion 6(a) de la Ley de Seguridad y Salud en el Trabajo de Puerto Rico:
El patrono no
proveyo empleo y un sitio de empleo libre de riesgos reconocidos que esten
causando o que
puedan causar muerte o dano fisico a los empleados, por cuanto empleados
estaban expuestos
a:
a.  Receive serious injuries, suffocation or death, due to hazardous
atmospheric
conditions where the employee was working inside confined space (manhole 2
feet
inch wide x 10 feet depth) and the employer did not perform test from the
internal
atmosphere located in Hostos Avenue #84, opposite Euroeast (Nissan) near
to traffic
light.  Among other methods, one feasible and acceptable abatement method
to correct
this hazard is perform tests from the internal atmosphere in relation to
concentration of
oxygen, flammable gases, vapors and potential toxic air contaminants
before the
employees enter.
a.  Recibir lesiones serias, asfixia o muerte, dado a condiciones
atmosfericas
peligrosas
donde el empleado estaba realizando trabajo dentro de espacio confinado
(manhole 2 pies
pulgada ancho x 10 pies profundidad) y el patrono no realizo pruebas de la
atmosfera
interna localizada en la Avenida Hostos #84, frente a Euroeste (Nissan)
cerca al
semaforo.  Entre otros metodos uno factible y aceptable para corregir este
riesgo es
realizar pruebas de la atmosfera interna en relacion a la concentracion de
oxigeno, gases
flamables, vapores y contaminantes toxicos potenciales en el aire antes
del empleado
entrar.
