Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to hazards of falling from an elevated position while
operating an aerial lift:
a.On or about 8/26/97, Danville, NH -  A Versalift aerial lift(vehicle
#22-98612)
was operated with safety defects due to inadequate repairs, inspections and
preventative maintenance program such as but not limited to the following:
inadequate repairs made to the door latch; inadequate repairs made to the
door
hinges; vehicle inspections not being performed at the intervals
recommended by
the manufacturer; and maintenance not being performed at the intervals
recommended by the manufacturer.
b.On or about 10/3, 14, 15, & 27/97 -  A Versalift aerial lift(vehicle
#22-98612)
was operated with safety defects due to inadequate repairs, inspections and
preventative maintenance program such as but not limited to the following:
inadequate repairs made to the door latch; vehicle inspections not being
performed at the intervals recommended by the manufacturer; and maintenance
not being performed at the intervals recommended by the manufacturer.
c.On or about 10/28/97, Danville, NH -  A Versalift aerial lift(vehicle
#22-189901)
was operated with safety defects due to inadequate repairs, inspections and
preventative maintenance program such as but not limited to the following:
inadequate repairs made to the door latch; vehicle inspections not being
performed at the intervals recommended by the manufacturer; and maintenance
not being performed at the intervals recommended by the manufacturer.
ABATEMENT NOTE: One method among others to abate this item would be to
have all repair
work performed to be equivalent to the original manufacturer's
specifications. Additionally, an
inspection program and a preventative maintenance program should be set up
and implemented
by a competent person based on the manufacturer's recommendations.
